Substantial modification

A substantial modification is a change after placing on the market that affects compliance with the essential requirements or modifies the intended purpose F-014. It is the concept that keeps the Regulation from being a one-shot gate: ship, then make a change that affects compliance or the intended purpose, and compliance is looked at again, with a third party who makes that change becoming the manufacturer F-014.

Why legacy fleets care

Products already on the market before the full-application date come under the main duty set only if substantially modified after it F-004. That makes "was this release a substantial modification" the single most economically loaded classification a legacy product team will make F-105 F-014.

The practical test

Changes that affect compliance or alter the intended purpose are the triggers F-014; Recital 39 (not operative) indicates that security updates which only reduce cybersecurity risk without changing the intended purpose are not substantial modifications, while feature updates that change intended functions or raise risk can be.
