Article 47 — Operational obligations of notified bodies
Operational duties of notified bodies: how assessments are actually run.
LAW Official text — verbatim from the Official Journal snapshot; only the Official Journal is authentic.
1.1. Notified bodies shall carry out conformity assessments in accordance with the conformity assessment procedures provided for in Article 32 and Annex VIII.
2.2. Conformity assessments shall be carried out in a proportionate manner, avoiding unnecessary burdens for economic operators. Conformity assessment bodies shall perform their activities taking due account of the size of undertakings, in particular as regards microenterprises and small and medium-sized enterprises, the sector in which they operate, their structure, their degree of complexity and the cybersecurity risk level of the products with digital elements and technology in question and the mass or serial nature of the production process.
3.3. Notified bodies shall however respect the degree of rigour and the level of protection required for the compliance of products with digital elements with this Regulation.
4.4. Where a notified body finds that the requirements set out in Annex I or in corresponding harmonised standards or common specifications as referred to in Article 27 have not been met by a manufacturer, it shall require that manufacturer to take appropriate corrective measures and shall not issue a certificate of conformity.
5.5. Where, in the course of the monitoring of conformity following the issuance of a certificate, a notified body finds that a product with digital elements no longer complies with the requirements laid down in this Regulation, it shall require the manufacturer to take appropriate corrective measures and shall suspend or withdraw the certificate if necessary.
6.6. Where corrective measures are not taken or do not have the required effect, the notified body shall restrict, suspend or withdraw any certificates, as appropriate.

Article 47 governs the assessment work itself: run under the Article 32 and Annex VIII procedures, carried out proportionately, avoiding unnecessary burden — particularly for SMEs — while staying rigorous about the essential requirements; where Annex I or the corresponding standards or common specifications are not met, calling for corrective measures and not issuing a certificate; and where a certified product no longer complies, calling for corrective measures and suspending or withdrawing the certificate if necessary, with restriction, suspension or withdrawal where corrective measures are not taken or do not work.
What to expect as a client
The article encodes the assessment's give-and-take: proportionality runs alongside rigour, and a body that finds unmet requirements asks for corrective measures and does not issue a certificate while they remain unmet. Arriving with the technical documentation complete is one of the schedule variables a manufacturer controls most directly.
Verified facts this page relies on
- F-026 Conformity routes: default products may use internal control (Module A), EU-type examination plus internal production control (Modules B+C), full quality assurance (Module H) or a European cybersecurity certification scheme; important class I must use B+C or H (or a scheme at 'substantial' level) unless harmonised standards, common specifications or such a scheme are applied in full; important class II must use B+C, H or a scheme at 'substantial' level; critical products use a European scheme where available, otherwise the class II procedures. Art. 32(1)–(4), Annex VIII
- F-016 Technical documentation (Annex VII) is drawn up before placing on the market and kept, with the EU declaration of conformity, for at least ten years after placing on the market or the support period, whichever is longer. Art. 13(12)–(13), Art. 31
