2.2. The notifying Member State shall provide the Commission, on request, with all information relating to the basis for the notification or the maintenance of the competence of the body concerned.
3.3. The Commission shall ensure that all sensitive information obtained in the course of its investigations is treated confidentially.

Article 46 gives the system its investigation lever: the Commission investigates cases where it doubts — or is made aware of doubts about — a notified body's competence or its continued fulfilment of the conditions, can obtain from the notifying Member State, on request, the information behind the notification, and, where it ascertains that a body does not or no longer meets the requirements, informs that Member State and asks it to take corrective measures, including de-notification if necessary.
The quiet deterrent
Most of this article's value is that it exists. Notified bodies compete for assessment business; a credible cross-border challenge mechanism is one check against that competition becoming a race toward the friendliest certificate.
