Article 37 sets the integrity conditions for notifying authorities themselves: established so that no conflict of interest arises with conformity assessment bodies, organised to safeguard objectivity and impartiality, structured so that each decision on notification is taken by competent persons other than those who carried out the assessment, and staffed to perform the tasks properly.
Why it reads like an audit standard
In effect: the chapter applies similar themes up and down the chain — independence, impartiality, confidentiality, competence — first to the authorities here, then to the bodies they notify. Reading Articles 37 and 39 side by side shows the pattern clearly.
